These Terms of Service (“Terms”) govern your access to and use of EVGREEN.us, EVGREEN Cloud, EVGREEN mobile applications, connected EVGREEN products, product registration, support services, documentation, and other services provided by EVGREEN Technology Inc. (“EVGREEN,” “we,” “us,” or “our”).
By accessing or using our website or Services, you agree to these Terms. If you do not agree, please do not use the Services.

1. Eligibility
You must be at least 18 years old, or have the consent of a parent or legal guardian where permitted by law, to use our Services.
By using the Services, you represent that you have the legal authority to agree to these Terms and will use the Services in compliance with applicable laws.
2. EVGREEN Website and Services
EVGREEN provides information, software, cloud services, mobile applications, product registration, technical support, and connected charging functionality for EVGREEN products.
EVGREEN.us is primarily an EVGREEN product, information, support, and services website.
EVGREEN products may be purchased through EVCO USA or authorized EVGREEN resellers. Unless expressly stated otherwise, product purchases, shipping, returns, refunds, taxes, and payment terms are governed by the seller from whom the product was purchased.
3. EVGREEN Cloud and Applications
EVGREEN Cloud and related applications may provide features including:
· Charger monitoring and management
· Charging-session information
· User and host access management
· Energy monitoring
· Power balancing and charging controls
· Charger status and diagnostics
· Site and charger administration
· Energy and usage reporting
· Remote configuration and supported software updates
4. User Accounts
Some Services may require an EVGREEN account.
You are responsible for:
· Providing accurate account information
· Keeping your login credentials secure
· Maintaining the confidentiality of your password or access credentials
· Activity performed through your account
· Promptly notifying EVGREEN of suspected unauthorized access
You may not share accounts or credentials in a manner that compromises the security of the Services.
5. Connected Chargers and Internet Availability
Certain EVGREEN features depend on internet access, Wi-Fi, cellular service, local communications, third-party networks, or cloud connectivity.
Temporary interruptions may occur because of:
· Internet or network outages
· Utility interruptions
· Maintenance
· Hardware or software updates
· Third-party service interruptions
· Events outside EVGREEN's reasonable control
EVGREEN does not guarantee uninterrupted or error-free connectivity at all times.
Certain local charging or safety functions may continue independently of cloud connectivity depending on the product and configuration.
6. Installation and Electrical Safety
EV charging equipment and related electrical products must be installed, configured, operated, and maintained in accordance with:
· EVGREEN installation instructions
· Product specifications
· Applicable electrical codes
· Local permitting requirements
· Utility requirements
· Applicable laws and regulations
Where required by law or product instructions, installation must be performed by a qualified or licensed electrician.
Users and installers must not exceed equipment ratings, electrical-service limits, breaker ratings, conductor ratings, or other applicable electrical limitations.
EVGREEN is not responsible for damage resulting from improper installation, unauthorized modification, misuse, incorrect electrical configuration, or failure to follow applicable instructions or codes.
7. Product Information
EVGREEN makes reasonable efforts to provide accurate product specifications, images, documentation, compatibility information, and other materials.
However, products and software may be improved or updated over time. Specifications, features, appearance, firmware, compatibility, documentation, and availability may change without prior notice where permitted by law.
Product images are illustrative and may differ slightly from the final product.
The applicable product manual and technical documentation should be followed for installation and operation.
8. Purchases Through EVCO USA or Authorized Resellers
EVGREEN products may be offered by EVCO USA or authorized EVGREEN resellers.
Purchases made through those sellers are governed by the applicable seller's:
· Pricing
· Payment terms
· Shipping policy
· Return and refund policy
· Taxes
· Order-processing terms
· Other applicable sales terms
Questions regarding an order should generally be directed to the seller from whom the product was purchased.
EVGREEN warranty and technical support are subject to the applicable EVGREEN Limited Warranty and service policies.
9. Software and Firmware
EVGREEN products may contain software or firmware provided by EVGREEN or its technology partners.
You may use such software only as necessary to operate the applicable EVGREEN product or Service.
You may not, except where permitted by applicable law:
· Copy or redistribute EVGREEN software
· Circumvent security features
· Attempt unauthorized access to EVGREEN systems
· Modify software or firmware without authorization
· Reverse engineer protected software
· Introduce malicious software or code
EVGREEN may provide firmware or software updates for security, compatibility, functionality, maintenance, or performance.
10. Prohibited Uses
You may not use EVGREEN Services to:
· Violate applicable laws or regulations
· Gain unauthorized access to accounts, chargers, systems, or networks
· Interfere with the operation or security of the Services
· Introduce viruses, malware, or harmful code
· Circumvent access controls or security mechanisms
· Impersonate another person or organization
· Use automated methods to improperly extract or overload data or systems
· Infringe intellectual-property or privacy rights
EVGREEN may suspend or terminate access when reasonably necessary to protect users, systems, products, or the integrity of the Services.
11. Intellectual Property
EVGREEN's website, software, applications, product designs, documentation, graphics, logos, trademarks, text, interfaces, and other materials are owned by EVGREEN Technology Inc. or its licensors and are protected by applicable intellectual-property laws.
Except as expressly permitted, you may not reproduce, modify, distribute, sell, license, publish, or commercially exploit EVGREEN content without prior written authorization.
12. Feedback
We welcome suggestions and feedback about EVGREEN products and Services.
If you voluntarily provide product suggestions, ideas, or feedback, you grant EVGREEN the right to use that feedback to develop, improve, and promote its products and Services without compensation or obligation to you.
Do not submit confidential or proprietary information through general feedback channels unless specifically requested.
13. Privacy
Our collection and use of personal information are governed by the EVGREEN Privacy Policy.
Connected chargers, EVGREEN Cloud, and EVGREEN applications may process charger, account, device, charging-session, energy, diagnostic, and related information as described in that policy.
14. Third-Party Services and Links
EVGREEN Services may integrate with or contain links to third-party websites, applications, networks, payment providers, installers, distributors, resellers, utilities, or technology services.
EVGREEN does not control independent third parties and is not responsible for their separate terms, privacy practices, content, or availability.
Your use of third-party services may be subject to additional terms established by those providers.
15. Warranty
EVGREEN hardware products are subject to the applicable EVGREEN Limited Warranty.
Warranty coverage, exclusions, claim procedures, and service requirements are governed by the warranty terms applicable to the product.
Nothing in these Terms limits any rights that cannot legally be excluded under applicable consumer-protection laws.
16. Disclaimer of Services
To the fullest extent permitted by applicable law, EVGREEN's website, cloud services, applications, and related online Services are provided on an “as available” basis.
EVGREEN does not guarantee that every Service will be uninterrupted, error-free, or compatible with every network, vehicle, electrical system, device, or third-party service.
Nothing in this section excludes warranties or consumer rights that cannot legally be excluded.
17. Limitation of Liability
To the fullest extent permitted by applicable law, EVGREEN Technology Inc., its affiliates, officers, employees, agents, and service providers will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages arising from use of or inability to use the Services.
Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by applicable law.
18. Force Majeure
EVGREEN will not be responsible for failure or delay caused by circumstances beyond its reasonable control, including natural disasters, fires, utility failures, internet or telecommunications outages, labor disputes, government actions, war, terrorism, supply-chain disruptions, or similar events.
19. Suspension or Termination
EVGREEN may suspend or terminate access to all or part of the Services if reasonably necessary because of:
· Violation of these Terms
· Fraudulent or unlawful activity
· Security concerns
· Unauthorized system access
· Abuse of EVGREEN systems
· Legal or regulatory requirements
Where appropriate, EVGREEN may provide notice or an opportunity to correct the issue.
20. Changes to the Services or Terms
EVGREEN may update these Terms periodically to reflect changes to our products, Services, business practices, or legal requirements.
Updated Terms will be posted on EVGREEN.us with a revised effective date.
Continued use of the Services following an applicable update constitutes acceptance of the revised Terms to the extent permitted by law.
21. Governing Law
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Subject to applicable consumer-protection laws, disputes relating to these Terms will be subject to the jurisdiction of the appropriate state or federal courts located in Los Angeles County, California.
22. Severability
If any provision of these Terms is determined to be invalid or unenforceable, the remaining provisions will continue in full force and effect.
23. No Waiver
EVGREEN's failure to enforce any provision of these Terms does not constitute a waiver of that provision or any other rights.
24. Entire Agreement
These Terms, together with applicable EVGREEN policies, constitute the agreement between you and EVGREEN regarding your use of the Services, unless another written agreement expressly applies.
